Do I have to have a health and safety policy at work?
All companies with 5 or more people must have a health and safety policy. When creating a policy, employees should be part of the process to cover areas that you as an employer might not see. It should include a statement of intent, structure of the organisation, with a list of who is responsible for what, when and how. The Policy should be reviewed on a regular basis.
Do health and safety laws apply to me and my business?
Health and safety policies and risk assessments apply to all businesses and must be recorded if you have 5 or more people. It applies to all sectors, including but not exclusive to housing, offices, retail, warehousing , schools, places of worship and charities!
Who enforces health and safety law?
The task of enforcing health and safety laws is shared between local authorities, the Fire Bridge and the Health & Safety Executive (HSE).
Do I need a health and safety law poster?
The Health and Safety Information for Employees Regulations 1989, requires employers to either display the HSE-approved law poster or to provide each of their workers with the equivalent leaflet. You must have a genuine one displayed in your workplace.
What happens if I break health and safety laws in the UK?
Maximum penalty: Unlimited fines and / or imprisonment.
Do I use hazardous substances?
Even if your work doesn’t include the use of chemicals, chances are you at least store and use cleaning fluids and detergents that could be hazardous if not properly managed.
The Control of Substances Hazardous to Health (CoSHH) regulations control the safe handling, storage and use of any potentially hazardous substances, including:
Oils, fuel & greases
Adhesives & paints
Cleaning materials
Substances generated during work activities (fumes from soldering, dust from grinding)
Naturally occurring substances (grain dust)
If you are an employer, it is your responsibility to ensure the safe management of all of these substances. You must carry out a CoSHH risk assessment, provide training and keep employees informed of policy and procedure. Unsure what you need? Get in touch!
What about insurance?
If you employ people, you must have insurance to cover you against any claims from your employees as a result of injury or ill health. It is advisable to have additional insurance to cover injury or loss to other people. Insurance will not cover a fine imposed as a result of a breach of law.
